Tickets Terms & Conditions

TERMS AND CONDITIONS

Each ticket is a revocable license that only grants entry into the Tournament premises and a spectator seat (or a standing location, as applicable) for the applicable ATX Open (the “Tournament”) session. The person seeking entry pursuant to such license, and any accompanying minors (“Holder”), agrees that such ticket license is subject to these terms, conditions, waivers and releases (“Terms”) and by acceptance and/or use of such ticket for the Tournament, Holder is deemed to have read and agreed to the Terms. The Terms include and incorporate the Tournament Ticket and Accreditation Policies, available on this page, provided that these Terms shall govern over any conflicting terms in such policies. Admission may be refused or withdrawn or Holder ejected in the sole discretion of Drop Shot LLC (“DropShot”), Women’s Tennis Association (“WTA”), the United States Tennis Association Incorporated (“USTA”), Westwood Country Club (“WCC”), and collectively with DropShot, WTA, USTA and WCC the “Tournament Parties”. Further, failure to comply with any of these Terms shall result in forfeiture of such license and all rights arising under it without refund and shall entitle the Tournament Parties to pursue all legal remedies available.

ALL SALES ARE FINAL. NO REFUNDS, CANCELLATIONS OR EXCHANGES WILL BE OFFERED OR PERMITTED UNLESS OTHERWISE STATED HEREIN.

If the entire Tournament is canceled prior to one official Tournament match ball being hit, and ticket Holder purchased Tournament tickets through the “Official Tournament Ticket Channel” (defined as ATXOpen.com), the Tournament will issue a refund of face value paid for the ticket (if any)(or, for a discounted ticket, the discounted ticket price paid) to the credit card, debit card, or other accepted method of payment that ticket Holder used to purchase this ticket. In the event of inclement weather, The foregoing is subject to applicable law and is limited to tickets purchased directly through the Official Tournament Ticket Channel, and does not apply to tickets (i) purchased via the secondary market, (ii) provided on a complimentary or barter basis, (iii) issued in connection with any sponsorship. If tickets were purchased through another method, please contact the person or entity from whom such tickets were purchased, as Tournament will not issue a refund directly to Holder. In no event will delivery charges or any other amounts be refunded. There will be no liability on the part of any of the Tournament Parties for travel or any other expenses that Holder or anyone else incurs in connection with a canceled Tournament.

Tournament capacity may be adjusted upward or downward without notice. Tournament dates and times (including the opening of the gates and schedule of play) are subject to change by the Tournament Parties in their sole discretion. If one hour of a match is completed on Center Court, a session is considered complete, and no exchanges or refunds will be made. If less than one hour of a match is completed on Center Court, Tournament management will make every effort to reasonably accommodate the individual session ticket holder for a subsequent session, if held. The ATX Open cannot guarantee ticket availability, exchange of equal value or comparable seat location. There will be NO REFUNDS OR CREDITS for sessions where one hour of a match is completed on Center Court. In addition, fans are advised that the ATX Open schedule of play is subject to change for all sessions. Tickets are not eligible for refund or exchange due to one or more changes in the schedule of play. Please note: Information on scheduling changes can be obtained by visiting our website’s homepage.

Holder may be relocated to an alternative seat in the sole discretion of the Tournament Parties. No such relocation shall entitle Holder to a refund or any other remedy if Holder is relocated to a seat of comparable face value.

Holder and Holder’s belongings may be searched prior to or upon entry and prohibited items may be confiscated. Holder must comply with the Tournament Parties’ security policies, including any applicable bag policy. Holder consents to such searches and waives any claims against the Tournament Parties (inclusive of their respective members, agents and affiliates) arising from or relating to such searches. If Holder elects not to consent to these searches or comply with these security policies, Holder acknowledges that the Tournament Parties have the right to deny Holder entry. No refund or other remedy will be provided if Holder is ejected or refused entry due to disorderly, unsafe, and/or threatening conduct or failure to comply with the ticket terms.

Holder will adhere to all Tournament safety and COVID protocols communicated to Holder by the Tournament Parties.

Holder voluntarily assumes all risks, hazards, and dangers incident to the Tournament and related events, including the risk of lost, stolen or damaged property or personal injury of any kind (including death), risk of exposure to communicable diseases, viruses, bacteria or illnesses or the causes thereof, sickness, and all hazards arising from, or related in any way to, the matches (including, but not limited to, injuries caused by players, fans, weather, tennis balls or other objects) whether occurring prior to, during or after any match, however caused and whether by negligence or otherwise, and hereby waives any and all claims or potential claims arising from such risks, damage or injuries. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PLACE WHERE PEOPLE ARE PRESENT. COVID-19 IS AN EXTREMELY CONTAGIOUS DISEASE THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. ACCORDING TO THE CDC, SENIOR CITIZENS AND THOSE WITH UNDERLYING MEDICAL CONDITIONS ARE ESPECIALLY VULNERABLE. BY ENTERING TOURNAMENT PREMISES, HOLDER VOLUNTARILY ASSUMES ALL RISKS RELATED TO EXPOSURE TO COVID-19. Holder agrees that the Tournament Parties and each of their parents, subsidiaries, affiliates, employees, agents and owners shall not be liable for any injuries, damages, claims or losses from any such causes.

IN NO EVENT SHALL THE TOURNAMENT PARTIES BE LIABLE FOR SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT OR EXEMPLARY DAMAGES OF ANY KIND INCLUDING AMOUNTS PAID IN EXCESS OF FACE VALUE. ANY DISPUTE OR CLAIM IN ANY WAY RELATED TO THIS TICKET OR THE TOURNAMENT SHALL BE RESOLVED BY MANDATORY, CONFIDENTIAL, FINAL, BINDING ARBITRATION BEFORE JAMS PURSUANT TO ITS STREAMLINED RULES. ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS AND HOLDER WAIVES ANY RIGHT TO ASSERT CLAIMS AS A CLASS ACTION, REPRESENTATIVE ACTION OR CLASS ARBITRATION. IF HOLDER DOES NOT CONSENT TO THIS, HOLDER MUST LEAVE OR NOT ENTER THE STADIUM. THIS CLAUSE IS GOVERNED BY THE FEDERAL ARBITRATION ACT.

No Holder may continually collect, disseminate, transmit, broadcast, publish, release or otherwise offer to the public (or assist any third party in offering to the public) from Tournament grounds any: (a) match scores or related statistical data during match play (from the commencement of a match through its conclusion) for commercial, betting or gambling purposes; or (b) on a live or delayed basis, in whole or in part, and whether on a free basis or subject to payment, any sound recording, photograph, livestream, video, motion picture, film and/or other audio-visual content captured by any means whatsoever or other accounts or descriptions of all or any part of the Tournament (collectively, the “Works”). Holder agrees that by causing this ticket to be scanned upon entry to the Tournament premises, Holder shall be deemed and understood to have signed this document and granted the Tournament Parties an exclusive, worldwide, sub-licensable, royalty-free license to all copyrights associated with the Works. The continual use of laptop computers or other handheld electronic devices within the confines (spectator area) of the Tournament match courts is prohibited.

Holder grants to the Tournament Parties and their respective designees the irrevocable permission to use Holder’s voice, image, and/or likeness in any media now or hereafter existing in connection with all or any part of the Tournament or related events, for any purpose whatsoever, including the commercial purposes of the Tournament Parties and/or their respective sponsors, licensees, advertisers and/or broadcasters, without further permission or compensation and hereby waives any and all claims or potential claims relating to such use.

The resale or attempted resale of this ticket on or around the Tournament premises/grounds at any price is prohibited and will result in Holder’s removal from the premises/grounds and confiscation of all tickets in the possession of the violator without refund or compensation. The use or attempted use of lost, stolen or counterfeit tickets is prohibited and such tickets are void. Breach of any of the foregoing conditions will automatically terminate the license granted by this ticket, and shall constitute grounds for denial of admission, removal from the premises/grounds, and confiscation of all tickets in the possession of the violator without refund or compensation. The Tournament Parties are not responsible for lost, stolen, destroyed, or counterfeit tickets. Lost, stolen, destroyed or counterfeit tickets, or tickets sold in violation of any applicable law, may not be honored. This ticket may not be used for, nor may any Holder enter the Tournament premises and/or stadium for, advertising, promotion or any other commercial purposes (including contests, sweepstakes and giveaways) without the Tournament Parties’ express written consent. The first ticket with this barcode presented to be scanned will be considered valid and all others will be rejected and entry denied to its holder.

RELEASE, WAIVER & COVENANT NOT TO SUE

On behalf of Holder and Holder’s Related Persons, Holder releases and covenants not to sue each of the Released Parties with respect to any and all claims that Holder or any of Holder’s Related Persons may have (or hereafter accrue) against any of the Released Parties that relate to any of the risks, hazards and dangers described above, including any and all claims that arise out of or relate in any way to (i) Holder’s exposure to COVID-19; (ii) Holder’s entry into, or presence within or around, the Tournament (including all risks related thereto, and including without limitation in parking areas or entry gates) or compliance with any protocols applicable to the Tournament; or (iii) any interaction between Holder and Released Parties personnel present at Tournaments, in each case whether caused by any action, inaction or negligence of any Released Party or otherwise.

Fan Health Promise

Stay-at-home: Holder agrees that neither Holder nor any Related Persons will attend an Tournament if any of the following is true on Tournament day:
• Within the prior 14 days, Holder has (or any person in Holder’s party or with whom Holder has close contact has) tested positive for, or been exposed to someone who has tested positive for, COVID-19;
• Within the prior 48 hours, Holder has (or any person in Holder’s party or with whom Holder has close contact has) experienced any symptoms of COVID-19 (e.g., fever, cough, shortness of breath, chills, loss of smell, nasal congestion, gastrointestinal discomfort, fatigue, etc.);
• Within the prior 14 days, Holder (or any Related Person with whom Holder has close contact) has traveled to a location identified by authorities as subject to travel or quarantine advisories due to COVID-19.

If you have ordered multiple Tournament events they may arrive in separate email attachments.

MOBILE DELIVERY (MD):

Tickets will also be accessible via the purchasers Tixr account by Friday, January 31, 2025. Tickets will be available in both PDF and mobile (i.e. Apple Wallet) formats.
